In order to allow you to take advantage of all of our site's features, KCSC may need to collect personal information from you. The type of information KCSC collects on our site depends upon what you do when you visit our site. For instance, if you wish to receive certain mailings, coupons, discounts, or notice of specials, you may need to provide one or more of the following: (1) your name; (2) your address; (3) your telephone number; (4) your fax number; (5) your birthdate; (5) the types of specials and deals that interest you most; (6) whether you want to receive certain mailings from KCSC; (7) whether you are a visitor or resident of the area; and (8) any comments you may have about the Kona Coast Shopping Center. We do not share personal information with third parties not related or affiliated to KCSC without your consent. If we plan to share your personal information with a third party, you will be notified of this at the time we collect the information, and you will have the opportunity to opt out of such use of your personal information.
Please be advised, however, that we reserve the right to disclose any personal information about you without your prior consent if we have a good faith belief that such disclosure is necessary to: (1) conform to legal requirements or comply with a valid legal process, such as a search warrant, subpoena, or court order; (2) protect our rights or property; (3) enforce the provisions of our Terms and Conditions of Use; or (4) prevent harm to you or others.
It is not necessary for you to provide personal information merely to visit our site, but access to certain portions of our site may be inaccessible to you. For instance, services such as mailings and special offers are not possible without the personal information you provide on our site.
B. Aggregate Information KCSC Collects Automatically
KCSC may also collect certain types of aggregate information automatically whenever you access and use our site. However, this information is aggregate in nature and is not by itself personally identifiable. For example, information about the sections of our site that people visit most frequently and least frequently help us decide which features website users find most useful. KCSC may sometimes share with third parties certain aggregate information. However, this information is not personally identifiable in any way and consists of facts such as the average numbers of visitors to our site per day and the most popular sections of our site.
If you decide that you would like to stop receiving information from us, either through the postal service or e-mail, you need only contact us and make such a request or click on the "Unsubscribe" button on our registration page.
B. Managing Your Personal Information
We believe it is important for you to be able to find out what personal information you have provided to us through our site. If you have provided us with personal information, you can contact us to request that we provide you with the personal information we have in records about you. We reserve the right to limit the number of times such a request can be made and to charge for responding to such requests if this process is misused or abused.
We know that you want the information we have on record about you to be as complete and accurate as possible. We feel the same way, since maintaining accurate information is essential to our efforts to give you the best possible experience when you visit our site and to provide you with the most up-to-date information about the exciting things happening at the Kona Coast Shopping Center. KCSC believes it is extremely important to protect children's personal information. In accordance with the Children's Online Privacy Protection Act (go to www.ftc.gov/kidzprivacy for more information about this Act), KCSC will not knowingly collect any personally identifiable information from children under the age of 13 without first obtaining parental consent.
B. Import Notice To Children Under the Age of 13
Personal information includes things such as name, address, email address, telephone number, or other information that would by itself or used in connection with other information allow someone to identify or contact you. Prior to providing personal information on our site by, for instance, entering a contest or sweepstakes, or participating in other activities or services offered through our site, children under the age of 13 must have a parent or legal guardian complete and return a Parental Consent Form. This is for your protection.
The completed form can be returned to us by fax to (808) 545-5689 or by email to firstname.lastname@example.org. The Parental Consent Form states that the parent or legal guardian, by his or her signature, consents to the collection and transfer of the child's personal information provided for a particular purpose. The parent or legal guardian may revoke this consent at any time by completing the Revocation of Parental Consent Form and sending it to the same address or fax number.
After parental consent has been obtained and verified, any personal information from children under the age of 13 will be collected and used only to the extent necessary for us to administer the activity or service and for aggregate purposes. We will not otherwise disclose information collected from children under the age of 13 to third parties not affiliated or associated with KCSC unless indicated otherwise on the Parental Consent. Such notification will also include the opportunity for the parent to opt out of such use. If a new activity or service is requested by a child under the age of 13, a new Parental Consent form must be submitted to and verified by us.
C. Important Notice to Parents
If you would like to review personal information about your child that we have on file, or request that certain information be changed or deleted, please contact us (see Contact Information in Section III above).
We encourage parents to monitor and supervise the online activities of their children and to consider using parental control tools that help prevent children under the age of 13 from disclosing their personal information without parental consent.
We know that when you provide us with personal information, you are trusting us to use reasonable efforts to keep it safe from unauthorized intrusion. We take reasonable steps, through the use of security software and protocols, to ensure that your personal information is safe. However, it is technologically impossible to guarantee that information will never be accessed by unauthorized persons.
IX. What You Need to Do to Protect Your Personal Information
You have several options when deciding how you can best protect your personal information. One option is simply not to volunteer any personal information. As stated above, this approach would allow you to still visit our site, but it would prevent you from taking advantage of some of our site's features, such as receiving our newsletter.
